Welcome to Fright Kit. The terms "we", "us" and "our" refer to Fright Kit, operated by Alexis Farque, sole proprietor, business registration (SIREN) 999 105 307, R.C.S. Chambéry, France. Fright Kit operates this website and store, including all information, tools, features, products and services available from it (the "Services"). Fright Kit uses the Shopify platform to provide the Services to you.

The terms below, together with the policies referenced in them (the "Terms"), describe your rights and responsibilities when you use the Services. They contain important information about your legal rights, including exclusions of warranty and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use or access the Services.

Article 1: Access and account

By agreeing to these Terms, you confirm that you have reached the age of legal majority in your state of residence, or that you use the Services with the consent and supervision of a parent or guardian. To purchase, you may be asked to provide information such as your email address, phone number, and billing, payment and shipping details. You represent that all information you provide is accurate, current and complete. You are responsible for the security of your account credentials and for any activity connected to your account.

Article 2: Our products

Fright Kit sells fan-made costume kits inspired by movies. They are not official merchandise, and Fright Kit is not affiliated with or endorsed by any film studio or rights holder.

We have made every effort to display our products accurately. Colors and appearance may differ from what displays on your screen. Product descriptions may change at any time without notice. We reserve the right to discontinue any product and to limit the quantities of any product we offer.

Costume kits are intended for teens and adults. Props, accessories and fake blood are not toys: keep them away from young children, and keep fake blood away from eyes and from fabrics that can stain.

Article 3: Orders

When you place an order, you are making an offer to purchase. We may accept or decline your order at our discretion. Your order is accepted once we confirm it and receive your payment. If we decline, change or cancel your order, we will contact you using the email address or phone number provided at checkout. Your purchases are subject to our Refund Policy. You represent that your purchases are for personal use, not for commercial resale.

Article 4: Pricing and billing

Prices are shown in US dollars and may change without notice. The price charged is the price in effect when your order is placed, as shown in your order confirmation email. Unless stated otherwise, displayed prices do not include taxes or shipping charges. Promotions and discount codes are governed by their own terms; if they conflict with these Terms, the promotion's terms govern. You represent that your payment information is accurate, that you are authorized to use the payment method, and that you will pay the charges incurred, including shipping and applicable taxes.

Article 5: Shipping and delivery

We ship to addresses in the United States only. Standard shipping is free on orders over $60 and costs $6.95 below $60. Delivery times, the Halloween order deadline and our Halloween delivery guarantee are described in our Shipping Policy, which forms part of these Terms. Apart from that guarantee, delivery times are estimates. Once your order is handed to the carrier, title and risk of loss pass to you.

Article 6: Intellectual property

The content of the Services, including text, images, graphics, video and their design and arrangement, belongs to Fright Kit or its licensors. These Terms permit you to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify or republish any material from the Services without our prior written consent.

Movie titles and character names are used only to describe the look a costume kit is inspired by. They are the trademarks or property of their respective owners, who do not sponsor or endorse Fright Kit. Shopify's name and logo are trademarks of Shopify.

Article 7: Optional tools and third-party links

The Services may offer access to third-party tools or links to third-party websites, which we do not monitor or control. We provide them "as is", without warranty or endorsement, and you use them at your own risk. Complaints or questions about third-party products or services should be directed to that third party.

Article 8: Relationship with Shopify

Fright Kit is powered by Shopify, which allows us to provide the Services to you. However, any sale or purchase made through our store is made directly with Fright Kit. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales between you and Fright Kit, including any damage, harm, or loss resulting from the products or services purchased. You hereby release Shopify and its affiliates from any claim, damages, and liability arising from or related to your purchase and transaction with Fright Kit.

Article 9: Privacy

Any personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be shared with Shopify and with third parties who may be located in countries other than your own, in order to provide you the Services.

Article 10: Feedback and reviews

If you send us ideas, suggestions, reviews, photos or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish and display that Feedback for any purpose, including commercial purposes. You represent that you own the rights to your Feedback and that it does not violate any right of a third party. We may remove any Feedback we find unlawful, offensive or in breach of these Terms.

Article 11: Errors, inaccuracies and omissions

The Services may occasionally contain errors related to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct any error and to change information or cancel orders if information is inaccurate, at any time, including after an order has been submitted.

Article 12: Prohibited uses

You may use the Services only for lawful purposes. You may not use them to commit fraud, infringe intellectual property rights, harass anyone, submit false information, send spam, upload malicious code, or scrape or copy the Services by automated means, including AI tools. We may suspend or terminate your access if you violate these rules.

Article 13: Agents

An "Agent" means any software or service acting autonomously or semi-autonomously on behalf of a person or entity. No Agent may access, use or interact with the Services unless it continuously identifies itself as such, including "Agent/[agent name]" in the user-agent string of every request, does not mimic human behavior or bypass CAPTCHAs, and answers honestly any question meant to determine whether it is a human. We may limit or block Agent access by technical measures.

Article 14: Termination

We may terminate these Terms or your access to the Services at our sole discretion, at any time and without notice. You remain responsible for all amounts due up to the date of termination. Provisions that by their nature should survive termination will survive.

Article 15: Disclaimer of warranties

EXCEPT AS EXPRESSLY STATED BY FRIGHT KIT, AND EXCEPT FOR ANY RIGHT YOU HAVE UNDER MANDATORY CONSUMER PROTECTION LAW, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THIS DISCLAIMER MAY NOT APPLY TO YOU.

Article 16: Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRIGHT KIT, ITS SERVICE PROVIDERS AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT OBTAINED THROUGH THEM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

Article 17: Indemnification

You agree to indemnify and hold harmless Fright Kit, Shopify and their affiliates, service providers and licensors from any claim made by a third party, including reasonable attorneys' fees, arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your use of the Services.

Article 18: Severability, waiver and entire agreement

If any provision of these Terms is found unenforceable, it will be enforced to the fullest extent permitted, and the rest of these Terms will remain in effect. Our failure to enforce any right is not a waiver of that right. These Terms and the policies posted on this site are the entire agreement between you and us regarding the Services.

Article 19: Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer them without your consent.

Article 20: Governing law

These Terms and any dispute relating to them or to the Services are governed by the laws of France, without regard to conflict-of-law principles. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer protection provisions of the law of the state where you live.

You can review the current version of these Terms at any time on this page. We may update these Terms by posting changes on our website. Changes take effect when posted, and your continued use of the Services after they are posted means you accept them.
